To maintain accurate records, you must promptly notify Wizard Perks of any modifications to your name or email address by sending an email to team@wizardperks.com. Please be aware that Wizard Perks cannot be held responsible for any communications directed to an email address that is no longer current.

Wizard Perks reserves the right to modify these Terms of Use, including any incorporated terms and conditions, at its discretion. These modifications take effect immediately upon posting and govern all subsequent Service usage.

As a Wizard Perks member, you may have access to various applications, including the App and Browser Extension, to enhance your account experience. To improve your shopping experience, these applications may gather certain information. Any collected data will be managed according to our Privacy Policy.

Accessing the Service and User Account Security

Wizard Perks maintains the authority to modify or discontinue aspects of the Service at its discretion, in accordance with agreements made with Your Organization. Unless specified otherwise in Your Organization's service agreement, Wizard Perks bears no responsibility if the Service becomes inaccessible, either partially or entirely, for any duration. Wizard Perks may occasionally limit user access to certain parts or the entirety of the Service.

As a user, you are accountable for:

• Arranging your own access to the Service
• Ensuring that anyone using the Service through your internet connection or access credentials adheres to these Terms of Use

To use the Service or certain features, you may need to provide registration information. You must ensure all information provided is accurate, up-to-date, and complete. Your use of the Service, including interactive features on the Rewards Platform, is subject to the Privacy Policy. You agree to Wizard Perks's handling of your information as outlined in the Terms of Use and Privacy Policy.

If you receive or choose a username, password, or other security information, treat it as confidential. Do not share this information with others. Your account is for your personal use only. Immediately report any unauthorized access or security breaches to Wizard Perks and Your Organization. Always log out after each session, especially when using public or shared computers.

Wizard Perks reserves the right to deactivate any user account, username, password, or identifier if it determines you have breached these Terms of Use.

Intellectual Property Rights

Wizard Perks retains ownership of the Service, including all its contents, features, and functionality. This encompasses information, software, text, visuals, audio, and the overall design. These elements are safeguarded by U.S. and international intellectual property laws.

These Terms of Use allow individual users to utilize the Service for personal, non-commercial purposes within their organization's program. Unless explicitly stated otherwise in these Terms or related documents:

1. You may not reproduce, distribute, modify, create derivative works, publicly display, perform, republish, download, store, or transmit Service materials, except for:
   
   1. Temporary RAM storage while accessing materials
   2. Automatic browser caching for display purposes
   3. Printing or downloading a reasonable number of pages for personal use
   4. Downloading applications for personal use, subject to Wizard Perks's license agreement
   5. Using social media features as intended

2. You are prohibited from:
   
   1. Altering copied materials
   2. Using visual or audio elements separately from accompanying text
   3. Removing copyright, trademark, or proprietary notices
   4. Accessing or using any part of the Service for commercial purposes

Violating these Terms may result in immediate termination of your Service access. You may be required to return or destroy any copied materials. Wizard Perks reserves all rights not expressly granted. Unauthorized use of the Service may violate various laws

License to Use the Service

These Terms of Use allow you to access and use the Service for personal purposes under a limited license granted by Wizard Perks. This permission is neither exclusive nor transferable. Wizard Perks maintains the authority to alter, adjust, or remove this license or any aspect of the Service at its discretion. Any rights not explicitly provided remain the property of Wizard Perks.

Trademarks

The Wizard Perks brand identity, including its name, logo, and associated elements like product names, service designations, designs, and taglines, are protected intellectual property of Wizard Perks or its affiliated entities and licensors. These marks cannot be used without explicit written consent from Wizard Perks. Any additional branding elements, such as names, logos, product or service identifiers, designs, and slogans featured on the Service belong to their respective owners and are subject to their own trademark protections.

Prohibited Uses

When using the Service, you must comply with these Terms of Use and all applicable laws. Prohibited activities include:

• Violating any laws or regulations, including those related to data export.
• Exploiting or endangering minors through inappropriate content or requests for personal information.

• Impersonating Wizard Perks, its employees, other users, or any individuals or entities.

Wizard Perks bears no responsibility to third parties for the content or accuracy of User Contributions posted by you or other users.

Should Wizard Perks grant you written permission to create a link to the Service or its homepage, you may do so under specific conditions. The link must be established in a manner that is both ethical and lawful, without harming Wizard Perks's reputation or exploiting it unfairly. You are prohibited from creating a link that implies any form of partnership, endorsement, or approval by Wizard Perks unless you have obtained explicit written authorization from the company to do so.

Links from the Service

The Service may include links to external websites and resources. These links are provided solely for your convenience. Wizard Perks does not oversee or manage the content of these external sites or resources and is not liable for any potential losses or damages resulting from your use of them. This applies to all third-party links, including those in advertisements and sponsored content. The Service may incorporate content from various external sources, including other users and third-party providers such as licensors, syndicators, aggregators, and reporting services. Any viewpoints, statements, or opinions expressed in these external materials are solely attributable to their respective authors or providers. This content, which is distinct from that produced by Wizard Perks, does not necessarily align with Wizard Perks's views. Wizard Perks disclaims responsibility for the content or accuracy of any third-party materials and cannot be held liable to you or any other party for such content.

Acceptance of Additional Rewards Program and Loyalty Program Terms ("Additional Terms")

In addition to the previously stated terms and conditions, Service users also agree to these Additional Terms:

• Eligible users may receive Points (“Points”), awarded at Wizard Perks's or Your Organization's discretion. Points hold no monetary value and can only be redeemed for purchases as determined by Wizard Perks. Points cannot be earned on purchases made using Points.
• Points are non-transferable between users or accounts and cannot be combined. They are for award purposes only and are not available to the general public.
• Points cannot be combined with other promotional programs.
• Users do not own Points. They cannot be bought, sold, or transferred under any circumstances.
• Points are redeemed in a specific order: Rewards Program Points first, then Loyalty Program Points. Expiration policies may apply and will be communicated to users.
• Users release Wizard Perks, Your Organization, and associated merchants from liability related to Points or program participation.
• Users are responsible for any tax implications arising from program participation.
• Wizard Perks's decisions regarding Point discrepancies are final.
• Point balance updates may experience delays.
• Wizard Perks reserves the right to disqualify users for abuse, fraud, or rule violations.
• The programs are void where prohibited by law. Points are not redeemable for cash.
• Terms may change without notice. Point redemption may be restricted or cancelled.
• Wizard Perks and Your Organization reserve the right to terminate the programs or user access.
• Participation in these programs is subject to the Privacy Policy.
• These Additional Terms aim to clarify the rules and limitations of the Points system and associated programs.

Governing Law and Venue

These Terms of Use are subject to the laws of Illinois, excluding its conflict of law principles. This applies as if the agreement were made and executed entirely within Illinois. Any legal actions arising from these Terms must be brought exclusively in state or federal courts situated in Cook County, Illinois. By agreeing to these Terms, you expressly accept the jurisdiction of these courts and waive any objections based on inconvenient forum.

Disclaimer and Limitations of Liability

We cannot guarantee that the Service will be free from viruses or other harmful code. You are responsible for implementing your own security measures and data backup procedures. To the maximum extent permitted by law, we are not liable for any damages caused by denial-of-service attacks, viruses, or other technologically harmful material that may affect your computer equipment, programs, data, or other property due to your use of the Service or any associated websites.

Your use of the Service, its content, and any related services or items is at your own risk. The Service is provided "as is" and "as available," without any warranties, either express or implied. Wizard Perks and its associates make no guarantees regarding the completeness, security, reliability, quality, accuracy, or availability of the Service. We do not warrant that the Service will be error-free, uninterrupted, free of viruses or other harmful components, or that it will meet your specific needs or expectations.

To the fullest extent allowed by law, Wizard Perks disclaims all warranties, whether express, implied, statutory, or otherwise. This includes, but is not limited to, warranties of merchantability, non-infringement, and fitness for a particular purpose.

These disclaimers do not affect any warranties that cannot be excluded under applicable law.

Wizard Perks reserves the right to correct any errors, inaccuracies, or omissions in product descriptions, pricing, and availability information on our website or in other materials, and to update information at any time without prior notice.

Waiver and Severability

If Wizard Perks chooses not to enforce a specific term or condition in these Terms of Use, it does not mean they have permanently waived their right to do so in the future. This applies to both that specific term and any other terms in the agreement. Additionally, if Wizard Perks fails to exercise a right or provision outlined in these Terms, it should not be interpreted as giving up that right or provision.

Should a court or other legal authority determine that any part of these Terms of Use is invalid, illegal, or cannot be enforced, that specific provision will be removed or reduced to the smallest extent possible. The remaining parts of the Terms of Use will continue to be fully effective and binding.

Entire Agreement

These Terms of Use, along with the Companion Agreement, Privacy Policy, Payment Terms and Conditions, and any other incorporated documents, form the complete and exclusive agreement between you and Wizard Perks concerning your access to and use of the Service. This comprehensive agreement replaces and overrides all previous verbal and written understandings, agreements, representations, and warranties related to the Service.
